Shop Terms & Conditions

All products displayed in our shop are sold subject to the Terms & Conditions set out below. Nothing mentioned in these conditions affects your statutory rights.

Orders 

All orders placed through our online shop are subject to availability and acceptance. After placing an order, you will receive an email acknowledging that we have received the full details of your order successfully and that the order is now being processed. The confirmation email will state the products you have ordered, the total cost including VAT (where applicable) as well as postage and packaging costs and your chosen delivery method and shipping address. Please check the confirmation email and notify us immediately of any errors by emailing info@deveron-projects.com. 

Upon successful completion of checkout, your order represents an offer to buy any goods at the prices indicated as well as any applicable delivery charges. If for any reason your order cannot be processed, a member of our team will contact you to explain the reason for this and offer an alternative if applicable. 

A contract between you and Deveron Projects is formed only when we dispatch the goods to you and send a confirmation email. It is only at this point in time that we accept your offer and are bound to fulfil it. 

Payment 

All prices are displayed in Pounds Sterling and include VAT where applicable, unless stated otherwise.

Payment must be made at the time of placing an order using the payment methods available at checkout. We accept credit or debit card payment via Stripe. 

We reserve the right to change prices at any time. The price charged will be the price displayed at the time your order is placed.

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and we will not be liable for any delay or non-delivery. If this happens we will contact you within 48 (working hours) of you placing your order to notify of this.

Cancellation

Under Distance Selling Regulations, you have the right to cancel an order with us within 14 days of receiving your order.  

We reserve the right to cancel any order prior to dispatch and will provide a full refund where applicable.

Returns

Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from Deveron Projects. Please see more information about our Returns Policy here.

Risk of damage in transit

We carry the risk of loss or damage to the products until you receive them. The products belong to you when you have received them and have paid us in full. If you return the products to us for any reason, they will become our property once they have been received and signed for by us and be at our risk from the time we receive them. 

Accuracy of information

We make every effort to ensure that product descriptions, images, and pricing are accurate. However, errors may occasionally occur. We are not responsible if information made available on this site is not accurate, complete or current.

If a pricing error is discovered for the cost of goods already ordered, we will contact you to inform you of this discrepancy as soon as possible. At this point we will inform you of the accurate price and ask that you reconfirm your order at the correct price, also giving you the option to cancel the order. If we are unsuccessful in contacting you we will assume the order cancelled and issue a full refund to you via the original payment method used.

Modifications to products and prices 

We reserve the right to modify or discontinue products at any time without notice.

Prices for products are subject to change without prior notice.

We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of a product.

Intellectual property

No permission is given by Deveron Projects in respect of the reproduction or use for injurious or commercial purposes of any brand names, product names, graphics, logos, icons, images, designs and any other material shown on the Deveron Projects online shop in which intellectual property rights subsist. You may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the content, in whole or in part. You may not use our name or logos or trademarks or any other content on any website of yours or that of any other person.

Accuracy to billing and account information

You agree to provide current, complete, and accurate purchase and account information for all orders. You agree to promptly update your account information to ensure we can complete your transactions and contact you where necessary.

We reserve the right to refuse or cancel any orders you place with us. This includes limiting or prohibiting orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors, or if we believe that the information provided is false, incomplete, or fraudulent. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. 

Copyright

Deveron Projects products and editions are Artworks specially commissioned or produced by Deveron Projects. It is the participating artists’ expectation that Artworks will not be purchased for resale and will be retained by you for your own personal enjoyment. Specifically, you may not sell or offer for sale the Artwork on any internet based auction or other website.

Copyright of the Artworks remains the property of the Artist.

You may not produce any image of your purchased artworks and may not, at any time, publish or submit for publication or reproduction any image of the artworks to any third party, including any internet website for any purpose other than for personal use.

If you breach any of your obligations under this section you agree that:

(a) the payment of damages will not be a sufficient remedy to compensate us or the artist for your breach;

(b) we may, and the artist may, apply to the court for an order to prevent you from

continuing to breach your obligations under these Terms and Conditions; and

(c) we may, and the artist may, contact the operator of any internet website on which the artworks is being offered for sale or on which an image of the artworks has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.
